[内容提要] 对我国古代书籍的版权保护问题进行探讨，发现以郑成思和William Alford为代表的中外版权法学者们的最大分歧在于是否承认我国古代存在现代意义上的版权保护活动，这是他们在同一版权概念语境下的视角差异。认为我国自宋代就已出现版权保护活动的主张是正确的，而如果高估那些零散的、区域性的版权保护活动在我国整个古代版权保护史上普遍性意义的做法值得商榷。

To Steal a Book Is Just an Elegant Offense?
——Discussion on Books’ Copyright Protection in Imperial China

[Abstract] This paper discusses book’s copyright protection in imperial China. The debate among Chinese and western scholars represented by Zheng Chengsi and William Alford, is whether copyright protection activities resembling present-day copyright law exist in imperial China, which reveals their different perspectives while using the same concept of copyright law. The point view that phenomena of copyright protection had emerged in Song dynasty is reasonable. However, it is worthy of reconsideration if we overrate the universality of those copyright protection activities in the history of Chinese copyright law.
